Terms of Service

Welcome, and thank you for cooking with us. These Terms of Service (“Terms”) are a binding agreement between you and The Therapeutic Chef, LLC, a Colorado limited liability company (“we,” “us,” or “our”), governing your use of thetherapeuticchef.com (the “Site”), our online cooking course, our newsletter, our discovery calls, and any related services we offer (collectively, the “Services”). By visiting the Site, enrolling in the course, signing up for our email list, or otherwise using the Services, you agree to these Terms. If you do not agree, please don’t use the Services.

1.Who we are

The Therapeutic Chef, LLC is a culinary education business based in Mancos, Colorado. Our work is led by Chef Jake Thompson, a Certified Therapeutic Chef. We teach foundational cooking skills, share recipes and meal plans, and provide one-on-one culinary instruction. You can reach us anytime at hello@thetherapeuticchef.com.

2.Not medical advice

Please read this carefully. The Therapeutic Chef is a culinary education business, not a medical, nutrition, or mental-health provider. Nothing on the Site, in the course, in our emails, in our discovery calls, or in any of our materials is medical advice, diagnosis, or treatment. We are not your doctor, dietitian, or therapist, and using our Services does not create any clinical relationship.

Always consult a qualified healthcare professional before making changes to your diet, especially if you are pregnant or nursing, managing a chronic condition, taking medication, or have a history of disordered eating. If you have a food allergy or intolerance, you are responsible for confirming that any recipe or ingredient is safe for you. You use our recipes, meal plans, and recommendations at your own risk.

3.The course

Our flagship offering is an online cooking course (“Kitchen Essentials,” the “Course”) delivered through a third-party platform (currently Kajabi). The Course includes pre-recorded modules, written materials, an initial consultation, and a one-on-one cooking session with Chef Jake. Specific deliverables, session length, and scheduling windows are described on the enrollment page at the time of purchase.

  • Enrollment. When you enroll, you receive a personal, non-transferable license to access the Course materials for your own household use. You may not share your login, redistribute the materials, or use the Course to teach paying students of your own.
  • Scheduling. You are responsible for scheduling your consultation and one-on-one session within the window communicated at purchase. Unused sessions expire at the end of that window.
  • Third-party platform.Your use of Kajabi is also governed by Kajabi’s terms and privacy policy. We are not responsible for outages, bugs, or data practices of third-party platforms.

4.Payment and refunds

Course tuition, currently $297 USD, is charged in full at enrollment unless a payment plan is offered in writing. Payments are processed by a third-party payment processor; we never see or store your full card number.

All sales are final. Because the Course includes a one-on-one consultation and personalized cooking session that we begin preparing for as soon as you enroll, all purchases are non-refundable. Please review the Course description, watch the free preview materials, and book a free discovery call with Jake before enrolling if you have any doubts. By completing checkout you acknowledge and accept this no-refund policy.

If our payment processor refunds you in error, you authorize us to re-charge the original payment method for the same amount. Chargebacks initiated without first contacting us in good faith may result in immediate termination of your access to the Course and the Services.

5.Discovery calls and consultations

Free discovery calls are intended to help you decide whether the Course is a good fit. They are conversational and non-clinical. We may decline to take a call, end a call early, or recommend that the Course is not the right fit for you. Recordings, if any, are made only with your consent.

6.Free meal plan and newsletter

You may opt in to receive our free anti-inflammatory meal plan and our weekly newsletter by submitting your email address. You can unsubscribe at any time using the link at the bottom of any email. The free materials are provided “as is” and are subject to the same disclaimers as the rest of the Services, particularly Section 2 (Not medical advice).

7.Intellectual property

All content on the Site and inside the Course, including recipes, photos, videos, written lessons, the meal plan, the shopping list, the brand name “The Therapeutic Chef,” and the look and feel of the Site, is owned by The Therapeutic Chef, LLC or its licensors and is protected by copyright, trademark, and other laws. You may cook the recipes for yourself, your family, and your friends, and you may share short snippets on social media with credit. You may not copy, republish, sell, or use our materials to train any machine-learning model without our prior written permission.

8.User conduct

When using the Services, you agree not to:

  • Share your Course login or distribute Course materials.
  • Harass, threaten, or harm Chef Jake, our staff, contractors, or other students.
  • Upload anything unlawful, infringing, or harmful to our systems.
  • Attempt to reverse-engineer, scrape, or interfere with the Site or the Course platform.
  • Use the Services to provide nutrition counseling or medical advice to others.

We reserve the right to suspend or terminate your access if you violate these Terms, with or without notice. If we terminate your access for cause, no refund is due.

9.Disclaimers

The Services are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Services will be uninterrupted, error-free, or produce any particular result. Cooking outcomes depend on many factors outside our control, including your equipment, ingredients, technique, and individual body.

10.Limitation of liability

To the fullest extent permitted by law, The Therapeutic Chef, LLC, its members, employees, contractors, and Chef Jake Thompson personally are not liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Services, including any health outcomes, allergic reactions, lost income, or emotional distress. Our total aggregate liability to you for any claim arising out of or related to the Services will not exceed the amount you paid us in the twelve months before the claim arose, or one hundred U.S. dollars ($100) if you paid nothing.

11.Indemnification

You agree to indemnify and hold harmless The Therapeutic Chef, LLC and its team from any claim, loss, or expense (including reasonable attorneys’ fees) arising out of your misuse of the Services, your violation of these Terms, or your violation of any law or third-party right.

12.Governing law and disputes

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-laws principles. Any dispute arising out of or related to the Services or these Terms will be resolved exclusively in the state or federal courts located in Montezuma County, Colorado, and you consent to personal jurisdiction there. You agree that any claim must be brought within one (1) year after it accrues, or it is permanently barred.

13.Changes to these Terms

We may update these Terms from time to time. When we do, we’ll change the “Last updated” date at the top of this page and, for material changes, give you reasonable notice (for example, by email or a notice on the Site). Your continued use of the Services after the change takes effect means you accept the updated Terms.
